Bir kamu d\u00fczeni sorunu olan yetki, yasa koyucu taraf\u0131ndan hangi makam veya\u00a0merciye\u00a0verilmi\u015f ise, ancak o makam veya merci taraf\u0131ndan kullan\u0131labilir. Bu bak\u0131mdan, yasan\u0131n a\u00e7\u0131k izni olmad\u0131k\u00e7a yetkili makam veya\u00a0mercinin\u00a0yetkisini devretmesi olanakl\u0131 de\u011fildir. Aktar\u0131lan nitelikleri gere\u011fi,\u00a0<strong>idare hukukunda yetkisizlik kural, yetkili olmak istisnad\u0131r.<\/strong>\u00a0Bu itibarla, yetki h\u00fck\u00fcmlerinin s\u0131n\u0131r ve \u00e7er\u00e7evesinin yasayla a\u00e7\u0131k\u00e7a \u00e7izilmesi gerekir ve geni\u015fletici yoruma tabi tutulamaz.<a name=\"_ftnref1\"><\/a><a href=\"https:\/\/celikhukukgrubu.com\/#_ftn1\">[1]<\/a><\/p>\n<p>\u0130mar mevzuat\u0131 uyar\u0131nca, plan kademelenmesinde alt d\u00fczeyde yer alan ve 3194 say\u0131l\u0131 \u0130mar Kanunu\u2019nun 5. maddesinde tan\u0131mlanan \u201c<em>naz\u0131m ve uygulama imar planlar\u0131<\/em>\u201dn\u0131 yapmak ve onaylamak bak\u0131m\u0131ndan yerel y\u00f6netimler \u201c<strong>genel yetkili<\/strong>\u201ddir.<a name=\"_ftnref2\"><\/a><a href=\"https:\/\/celikhukukgrubu.com\/#_ftn2\">[2]<\/a>\u00a03194 say\u0131l\u0131 \u0130mar Kanunu, imar planlar\u0131 a\u00e7\u0131s\u0131ndan \u201cgenel kanun\u201d h\u00fckm\u00fcnde olup an\u0131lan Kanun\u2019un 8. maddesinde\u00a0<em>\u201c\u00a0belediye s\u0131n\u0131rlar\u0131 i\u00e7inde kalan yerlerin n\u00e2z\u0131m ve uygulama imar planlar\u0131 ilgili belediyelerce yap\u0131l\u0131r veya yapt\u0131r\u0131l\u0131r.\u201d\u00a0<\/em>d\u00fczenlemesi yer almaktad\u0131r. An\u0131lan madde h\u00fckm\u00fc, belediyelere verilen yetkinin yasal dayana\u011f\u0131n\u0131 olu\u015fturmaktad\u0131r.<\/p>\n<p>\u0130mar Kanunu\u2019nun 8. maddesi ile belediye s\u0131n\u0131rlar\u0131 i\u00e7indeki naz\u0131m ve uygulama imar planlar\u0131n\u0131 yapma ve onaylamada genel yetki belediyelerde ise de, gerek ayn\u0131 kanunda gerekse \u00f6zel nitelikli yasal d\u00fczenlemeler ile istinai olarak \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2019na, \u00f6zel bir tak\u0131m yetkiler tan\u0131m\u0131\u015f oldu\u011fu da g\u00f6r\u00fclmektedir. S\u00f6z konusu yetkilerden ilki, \u0130mar Kanununun 8. maddesinin (d) bendinde<a name=\"_ftnref3\"><\/a><a href=\"https:\/\/celikhukukgrubu.com\/#_ftn3\">[3]<\/a>\u00a0yer almakta olup an\u0131lan d\u00fczenleme ile planlar\u0131n kademeli birlikteli\u011fi ilkesine uygun bi\u00e7imde, alt kademede yer alan planlar\u0131n belirli bir s\u00fcre i\u00e7inde \u00fcst kademede yer alan planlara uygun hale getirilmesi, alt ve \u00fcst kademe planlar\u0131 yapan idarelerin farkl\u0131 olmas\u0131 ve bu y\u00f6ndeki de\u011fi\u015fikliklerin alt kademe planlar\u0131n\u0131 yapma ve onaylamaya yetkili idareler taraf\u0131ndan ilgili s\u00fcrede yapmaktan ka\u00e7\u0131n\u0131lmas\u0131 halinde, s\u00f6z konusu planlar\u0131n, do\u011frudan \u00fcst kademedeki planlar\u0131 yapmaya yetkili idareler taraf\u0131ndan yap\u0131labilmesini m\u00fcmk\u00fcn k\u0131lmak amac\u0131yla getirildi\u011fi g\u00f6r\u00fclmektedir. Dolay\u0131s\u0131yla \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2019n\u0131n, naz\u0131m imar plan\u0131n \u00fcst kademesinde yer alan bir plan\u0131n bulunmad\u0131\u011f\u0131 veya bulunsa bile bu plan\u0131n ad\u0131 ge\u00e7en Bakanl\u0131k\u00e7a yap\u0131lmam\u0131\u015f ve onaylanmam\u0131\u015f oldu\u011fu haller bak\u0131m\u0131ndan, alt kademede yer alan planlarda herhangi bir de\u011fi\u015fiklik yapma yetkisine sahip olmad\u0131\u011f\u0131 sonucuna ula\u015f\u0131lmaktad\u0131r.<\/p>\n<p>\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2019n\u0131n yetkisine ili\u015fkin bir di\u011fer d\u00fczenleme de, \u0130mar Kanunu\u2019nun 8. maddesinin (g) bendinde<a name=\"_ftnref4\"><\/a><a href=\"https:\/\/celikhukukgrubu.com\/#_ftn4\">[4]<\/a>\u00a0yer almaktad\u0131r. Buna g\u00f6re madde h\u00fckm\u00fc ile Bakanl\u0131\u011fa, ilgili belediyeler \u00fczerinde tan\u0131nan idari vesayetin yans\u0131mas\u0131 olarak, yaln\u0131zca ilgili belediyelerce yap\u0131l\u0131p onaylanan planlar\u0131n uygulanmas\u0131na y\u00f6nelik i\u015flemlere ili\u015fkin denetim ve m\u00fcdahale yetkisi ile s\u0131n\u0131rl\u0131 olarak yetki verildi\u011fi g\u00f6r\u00fclmektedir. \u00d6rne\u011fin; ilgili belediyesince mevcut imar plan\u0131na ayk\u0131r\u0131 bir ruhsat verilmesi veya parselasyon i\u015flemi yap\u0131lmas\u0131 durumu s\u00f6z konusu ise, \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131, bu ayk\u0131r\u0131l\u0131\u011f\u0131 gidermeye yetkili k\u0131l\u0131nm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla madde h\u00fckm\u00fcn\u00fcn, \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2019na belediyelerce yap\u0131l\u0131p onaylanan imar planlar\u0131n\u0131, onlar\u0131n yerine ge\u00e7erek de\u011fi\u015ftirme yetkisi verdi\u011fini s\u00f6ylemek m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>\u00d6te yandan, bizzat \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131nca, \u0130mar Kanunu\u2019nun 8. maddesine eklenen (d) ve (g) bentleri h\u00fck\u00fcmlerinin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihinden sonra, 4.06.2014 tarih ve 29030 say\u0131l\u0131 Resm\u00ee Gazete\u2019de yay\u0131nlanarak y\u00fcr\u00fcrl\u00fc\u011fe konulan\u00a0<em>\u201cMekansal Planlar Yap\u0131m Y\u00f6netmeli\u011fi\u201d<\/em>nin 35. maddesinin 1. f\u0131kras\u0131 ile getirilen d\u00fczenlemede \u201c<em>Planlar\u0131n,\u00a0 \u2026 imar mevzuat\u0131na uygunlu\u011funun sa\u011flanmas\u0131 plan\u0131 yapan ve onaylayan idarelerin sorumlulu\u011fundad\u0131r\u201d\u00a0<\/em>denilerek as\u0131l sorumlulu\u011fun yerel y\u00f6netimlerde oldu\u011fu belirtilmi\u015f, \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131n\u0131n yetkisinin<em>\u00a0\u201cPlanlar\u0131n 3194 say\u0131l\u0131 \u0130mar Kanunu ve bu Y\u00f6netmeli\u011fe uygunlu\u011funun izlenmesi ve incelenmesi\u201d<\/em>\u00a0ile s\u0131n\u0131rl\u0131 oldu\u011fu a\u00e7\u0131k\u00e7a vurgulanm\u0131\u015ft\u0131r.<\/p>\n<p>\u0130mar Kanunu\u2019ndan ayr\u0131 olarak \u00f6zel nitelikli yasal d\u00fczenleme ile istinai olarak \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2019na tan\u0131nan yetkilerden bir di\u011feri ise, 2.7.2018 tarih ve 703 say\u0131l\u0131 Kararname ile y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lan 29.6.2011 tarih ve 644 say\u0131l\u0131\u00a0<em>\u201c\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararname\u201d<\/em>\u00a0ve bu Kararnamenin yerini alan h\u00fck\u00fcmler ihtiva eden 1 Numaral\u0131 Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesinin 97 ve 102. maddeleridir<a name=\"_ftnref5\"><\/a><a href=\"https:\/\/celikhukukgrubu.com\/#_ftn5\">[5]<\/a>. An\u0131lan maddeler ile \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2019na naz\u0131m ve uygulama imar planlar\u0131 bak\u0131m\u0131ndan verilen yetkilerin ya\u00a0<em>\u201ckonu ve amac\u0131 itibar\u0131 ile\u00a0\u00f6zellik arz edenler\u201d<\/em>\u00a0ya da \u201c<em>kamu mallar\u0131 ve yat\u0131r\u0131mlar\u0131na d\u00f6n\u00fck olanlar\u201d<\/em>la s\u0131n\u0131rl\u0131 oldu\u011fu g\u00f6r\u00fclmektedir.<\/p>\n<p>Bu kapsamda, yasal mevzuat \u00e7er\u00e7evesinde, \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2019n\u0131n ancak \u00fcst kademede yer alan planlara veya imar mevzuat\u0131na ayk\u0131r\u0131l\u0131k hallerinde kullan\u0131labilece\u011fi \u015farta ba\u011fl\u0131 yetkiler ile donat\u0131ld\u0131\u011f\u0131 kabul edilmektedir. Nitekim Anayasa Mahkemesi de<a name=\"_ftnref6\"><\/a><a href=\"https:\/\/celikhukukgrubu.com\/#_ftn6\">[6]<\/a>\u00a0yukar\u0131da yer verilen istisnai sebep ve \u015fartlar\u0131n yoklu\u011funda\u00a0<em>\u201cmerkezi y\u00f6netime gerekli g\u00f6r\u00fclen hallerde yerel y\u00f6netimlerin yerine ge\u00e7erek planlamay\u0131 parsel d\u00fczeyine kadar d\u00fczenleme yetkisi ver(ilen)\u201d\u00a0<\/em>kanuni d\u00fczenleme ve buna dayal\u0131 uygulamalar\u0131n<em>\u00a0\u201cyerel y\u00f6netimlerin\u00a0\u00f6zerkli\u011fine idari vesayet yetkisinin kullan\u0131lmas\u0131 d\u0131\u015f\u0131nda bir m\u00fcdahale olana\u011f\u0131 tan\u0131mayan Anayasa\u2019n\u0131n 127. maddesi ile ba\u011fda\u015f(mayaca\u011f\u0131)&#8230;\u201d,<\/em>\u00a0<em>\u201cmerkezi y\u00f6netimin yerel y\u00f6netimlerin planlama yetkilerine&#8230; s\u0131n\u0131r\u0131 belirsiz bi\u00e7imde geli\u015fig\u00fczel el atmas\u0131ndan s\u00f6z edilebilece\u011fi\u201d<\/em>ne ve i\u015f bu durumun Anayasa\u2019ya ayk\u0131r\u0131 olaca\u011f\u0131na i\u015faret etmek suretiyle imar planlar\u0131n\u0131n kamu yarar\u0131 ihtiva etmesi gereklili\u011fi ve \u00fclke geneliyle ilgileri nedeniyle, \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2019n\u0131n yukar\u0131da yer verilen istisnai, \u015farta ba\u011fl\u0131, s\u0131n\u0131rl\u0131 ve daha ziyade makro d\u00fczeyde yetkili k\u0131l\u0131nd\u0131\u011f\u0131n\u0131n alt\u0131n\u0131 \u00e7izmi\u015ftir.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 Av.
